Yet Another Case of Art Theft

Although this time it's worse.
Apparently, this girl Lara Jade (who is 17) had a self portrait of her that she took when she was 14 ripped and used as the cover for a porn DVD without approval or permission.
This seems to me to be an ultimate low of art thievery and a new low for character defamation.
A Digg user, halleyscomet, contacted one of the vendors of the DVD. Here is their e-mail and the company's response:

You need to be made aware that the THX video you're selling entitled "Body Magic" features a 14 year old cover model. You're using a photo of a minor to sell porn, and your "everyone is 18 or older" disclaimer is a flat out lie. I'm not certain but I suspect that this may be illegal. If not illegal, selling a video with an underage model is not going to be good publicity.
The Vendor says:
First off, if you're going to send an email as such, how about providing some "proof". We are not the producer of this film. This movie is from 1995 and we don't even have it in stock. As you can see from the cover, the "model" is fully clothed, nothing illegal about that, and in addition you can't even see the models face, so how can you even tell who she is? We will forward your email to the appropriate people.

The model, who took the photo herself, has posted about it in her Blog. http://larafairie.deviantart.com/journal/13087896/ Even if it isn't illegal, the DVD is a copyright violation. I understand that you are an innocent party in all this, and that you had no way of knowing that the video infringed anyone's copyrights or that the model was 14 at the time the photo was taken. Given the legally dubious status of the DVD, simply removing it from your online catalog will probably be the extent of what anyone expects of you.

The reference to 18 and over is for the actors, and not necessarily persons depicted on the box cover. And since she didn't star in it then there is no legal issue other than one she might have with TVX. And as I noted earlier, you cannot even make out who or what the model looks like. Thanks again.
